Terms and Conditions for the provision of electronic services via the labhome.pl website and online store.

I. Definitions

Terms used in these Terms and Conditions mean:
1.1. labhome.pl – the website and online store operated by the Seller at: https://labhome.pl, through which the Customer can browse content and place Orders;
1.2. Seller – ZBADAJSIE SP. Z O.O. with its registered office at ul. Norwida 1/2, 48-300 Nysa, the owner and administrator of the labhome.pl online store, responsible for fulfilling Sales Agreements.
1.3. User – any person visiting labhome.pl;
1.4. Customer – any entity making purchases through labhome.pl;
1.5. Consumer – a natural person entering into an agreement with the Seller via labhome.pl, the subject of which is not directly related to their business or professional activity. Provisions concerning the Consumer also apply to an Entrepreneur with Consumer Rights, if this results from applicable law;
1.6. Entrepreneur with Consumer Rights – a natural person conducting business activity, entering into a Sales Agreement with the Seller directly related to their business activity, when the content of this Agreement indicates that it does not have a professional character for that person, resulting in particular from the subject of the business activity disclosed on the basis of regulations on the Central Register and Information on Business Activity (CEIDG). Provisions concerning the Consumer apply to such a person to the extent provided by applicable law;
1.7. Product / Goods – movable property available and presented in the labhome.pl online store, a Self-Testing Device, being the subject of a Sales Agreement between the Customer and the Seller;
1.8. Cart – a software element of the labhome.pl online store, in which Products selected by the Customer for purchase are visible, and where it is possible to determine and modify Order details, in particular the quantity of products;
1.9. Order Form (Checkout) – an interactive form available in the labhome.pl online store enabling the placement of an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment;
1.10. Order – a declaration of intent by the Customer made using the Order Form, aimed directly at concluding a Sales Agreement with the Seller;
1.11. Sales Agreement – an agreement for the sale of Goods within the meaning of the Civil Code, concluded between the Seller and the Customer, entered into using the store’s infrastructure;
1.12. Distance Contract – a contract concluded with the Customer as part of an organized distance selling system (via the labhome.pl online store), without the simultaneous physical presence of the parties, using exclusively one or more means of distance communication up to and including the conclusion of the contract;
1.13. Civil Code – the Act of April 23, 1964;
1.14. Act on the Provision of Electronic Services – the Act of July 18, 2002 on the provision of electronic services;
1.15. Consumer Rights Act – the Act of May 30, 2014 on consumer rights;
1.16. Act on Competition and Consumer Protection – the Act of February 16, 2007 on competition and consumer protection;
1.17. Personal Data Protection Act – the Act of May 10, 2018 on the protection of personal data;
1.18. Copyright and Related Rights Act – the Act of February 4, 1994 on copyright and related rights;
1.19. Industrial Property Law Act – the Act of June 30, 2000 – Industrial Property Law;
1.20. Medical Devices Act – the Act of April 7, 2022 on medical devices;
1.21. Pharmaceutical Law – the Act of September 6, 2001 – Pharmaceutical Law;
1.22. Self-Testing Device – an in vitro diagnostic medical device intended by the manufacturer for use in a home environment by a person who is not a professional User, who will relate the test result to the person being tested;
1.23. Certificate of Conformity CE – a document issued by a notified body in the field of devices, certifying the completion of a conformity assessment procedure, confirming that a properly identified device, its design, type, manufacturing process, sterilization or final inspection and testing complies with essential requirements;
1.24. Directive 98/79/EC – Directive of the European Parliament and of the Council of October 27, 1998 on in vitro diagnostic medical devices, repealed by Regulation (EU) 2017/746;
1.25. Regulation (EU) 2017/746 – Regulation (EU) 2017/746 of the European Parliament and of the Council of April 5, 2017 on in vitro diagnostic medical devices and repealing Directive 98/79/EC and Commission Decision 2010/227/EU;

II. General Provisions

2.1. The Seller in the labhome.pl online store is: ZBADAJSIE SP. Z O.O. with its registered office in Nysa at ul. Norwida 1/2, 48-300 Nysa

entered in the National Court Register by the Regional Court in Opole, 8th Commercial Division of the National Court Register
2.2. Contact with the Seller is possible:
a) via email: info@labhome.pl;
b) by phone: +48 730 332 383 from 8:00 AM to 5:00 PM on business days;
c) in writing to the address: ZBADAJSIE SP. Z O.O. ul. Norwida 1/2, 48-300 Nysa;
2.3. The Seller declares that it is authorized – organizationally, legally, and commercially – to sell the offered Products;
2.4. These Terms and Conditions define the rules for using labhome.pl;
2.5. These Terms and Conditions constitute the regulations referred to in Article 8 of the Act on the Provision of Electronic Services;
2.6. These Terms and Conditions are made available free of charge on the website in a manner enabling their acquisition, reproduction, and recording.
2.7. These Terms and Conditions specify in particular:
a) the conditions and rules for placing orders electronically via the labhome.pl online store;
b) the principles and procedure for concluding a Distance Sales Agreement with the Consumer via the labhome.pl online store;
2.8. Using labhome.pl services is possible by having access to devices allowing the use of Internet resources: an email inbox and a web browser enabling the display of websites;
2.9. It is recommended to use the following web browsers: Google Chrome, Opera, Mozilla, Safari iOS (it is recommended to use the latest browser versions);
2.10. Products presented and offered via labhome.pl are Self-Testing Devices;
2.11. All information about Goods, including description, price, technical and functional parameters, constitutes an invitation to conclude a Sales Agreement within the meaning of Article 71 of the Civil Code;
2.12. The User is obliged in particular to:
a) use labhome.pl in a manner that does not disrupt its operation and functioning;
b) refrain from actions constituting spam or disrupting the operation of the service;
c) use any copyrighted content posted on labhome.pl only for personal use. Copying and using content posted by labhome.pl is prohibited;

III. Product Characteristics

3.1. Products offered via the labhome.pl online store are in vitro diagnostic medical devices intended for self-testing, in accordance with applicable law;
3.2. Products offered by the Seller are placed on the market in accordance with requirements arising from applicable national law and European Union law concerning medical devices and in vitro diagnostic medical devices;
3.3. Information regarding the properties, intended use, method of use, limitations of use, and other characteristics of Products is presented on the pages of individual Products available in the labhome.pl online store and in the documentation provided by the manufacturer;
3.4. Products offered by the Seller have the legally required markings, declarations of conformity, certificates, or other documents permitting their legal placing on the market, if required by applicable law;
3.5. The Customer is obliged to use the Products in accordance with their intended purpose, instructions for use, and manufacturer’s recommendations;
3.6. Results obtained using the Products are informational in nature and do not replace professional medical diagnostics, medical consultation, or tests performed by authorized medical entities;
3.7. In the event of obtaining a result that raises doubts, a positive result, or the occurrence of disease symptoms, consultation with a doctor or other qualified healthcare professional is recommended;

IV. Order

4.1. The labhome.pl online store accepts Orders 24 hours a day, year-round;
4.2. The Customer can place an order in the labhome.pl Online Store without the need to register and log in, i.e., without creating an individual account;
4.3. To place an Order, you must:
a) go to the Products section;
b) select the Product that is the subject of the Order, then click the “Add to cart” button;
c) click “View cart” or go to the “in cart” page located in the top menu by expanding the tab and clicking the “Cart” button;
d) check the contents of the Cart as a summary of the Order;
e) select a shipping option: DPD courier, DPD delivery to a point (Pickup), or InPost Parcel Lockers
f) proceed to Checkout by clicking the “Proceed to checkout” button;
g) correctly and carefully complete the Order form by entering the Order recipient’s details and the Goods delivery address;
h) select the payment method for the Product and shipping;
i) accept the Terms and Conditions;
j) click the “Buy and pay” button;
4.4. The Store is not obliged to fulfill Orders if:
a) the Order form has been completed incompletely or incorrectly;
b) If, for technical reasons, the Order was not successfully registered in the Seller’s system, the contract is not concluded, of which the Customer will be immediately informed;
c) the Seller has withdrawn a given product from sale or the assortment has been exhausted, of which the Seller is obliged to immediately inform the Customer;
4.5. Information regarding Orders can be obtained by phone: 730 332 383 – Monday to Friday, 10:00 AM – 5:00 PM or by email: zamówienia@labhome.pl

V. Payment

5.1. Product prices are given in Polish zloty and include VAT (gross prices);
5.2. Product prices do not include delivery costs;
5.3. Product prices are binding for the Customer at the time of placing the Order;
5.4. The delivery cost is added to the price of the Goods, which together constitutes the total value of the Order;
5.5. For selected products in our store, you can pay in the following ways:
a) via the Przelewy24 system (BLIK, bank transfers);
b) via the Przelewy24 system (card payment);
Note: the payment card operator is PayPro SA Settlement Agent, ul. Kanclerska 15, 60-327 Poznań, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Poznań, Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS number 0000347935, Tax ID 7792369887, REGON 301345068.
5.6. The document confirming each sale, regardless of the selected payment option, is a VAT Invoice attached to the shipment;

VI. Conclusion of Sales Agreement

6.1. The conclusion of a Sales Agreement between the Customer and the Seller occurs after the Customer has placed an Order using the procedure described in Part IV of the Terms and Conditions;
6.2. Sending an Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement with the Seller in accordance with the Terms and Conditions;
6.3. After placing an Order, the Seller confirms its receipt and accepts the Order for fulfillment. Confirmation of receipt of the Order along with acceptance for fulfillment occurs by the Seller sending an appropriate email message to the email address provided by the Customer when placing the Order;
6.4. The contract is concluded at the moment the Customer receives the email message referred to in the above point;
6.5. Each email confirming the Order contains:
a) the Order number;
b) the subject of the Order;
c) unit and total prices of Products;
d) delivery cost;
e) the selected payment method;

VII. Delivery

7.1. Delivery of ordered goods takes place to the address provided by the Customer in the Order form;
7.2. We deliver ordered goods via DPD courier service and to InPost Parcel Lockers;
7.3. Shipment of ordered goods usually takes place within 2 business days;
7.4. We ship goods in special, damage-resistant packaging;
7.5. Shipments are delivered in packaging that prevents product identification without unpacking;
7.6. Shipping costs within Poland:
a) DPD Pickup – delivery to a point: 13.99 PLN
b) DPD Courier – door-to-door delivery: 16.99 PLN
c) InPost Parcel Locker 24/7 – from 16.99 PLN to 19.99 PLN depending on the quantity of products ordered (shipment size)
7.7. The shipping cost is added to the price of the Goods, which constitutes the total value of the Order;
7.8. The Seller is not liable for delays resulting from force majeure or circumstances beyond its reasonable control; however, this does not limit the Consumer’s rights under applicable law;
7.9. In the event that the Customer fails to collect a shipment delivered according to the selected delivery method or refuses to accept it, resulting in the return of the shipment to the Seller for reasons beyond the Seller’s control but attributable to the Customer, the Seller has the right to charge the Customer for all actually incurred costs related to the fulfillment of the order, the return of the shipment, and its potential re-dispatch, and to deduct the due amounts from any funds subject to refund to the Customer;

VIII. Right of Withdrawal from the Contract

8.1. A Consumer and an Entrepreneur with Consumer Rights who has concluded a Distance Sales Agreement may withdraw from it without giving a reason within 14 days from the day the Goods are taken into possession by themselves or a third party indicated by them, other than the carrier;
8.2. To exercise the right of withdrawal from the contract, the Customer should inform the Seller of their decision by submitting an unambiguous statement sent electronically or in writing to the contact details specified in the Terms and Conditions;
8.3. To meet the deadline for withdrawal from the contract, it is sufficient to send the statement before the expiry of the period specified in point 8.1.;
8.4. In the event of effective withdrawal from the contract, the Seller will refund to the Customer all payments received from them, including the costs of delivering the Goods to the Customer in an amount corresponding to the cheapest standard delivery method offered by the Seller, subject to exceptions arising from applicable law;
8.5. The refund will be made immediately, no later than within 14 days from the day of receiving the statement of withdrawal from the contract. However, the Seller may withhold the refund until receipt of the returned Goods or until the Customer provides proof of their return, depending on which event occurs first;
8.6. The Customer is obliged to return the Goods immediately, no later than within 14 days from the day of withdrawal from the contract;
8.7. The Customer bears the direct costs of returning the Goods;
8.8. The Customer is liable for any diminished value of the Goods resulting from using them in a manner beyond what is necessary to establish the nature, characteristics, and functioning of the Goods;
8.9. The right of withdrawal from the contract does not apply in cases provided for by applicable law, in particular with respect to Goods delivered in sealed packaging which cannot be returned after opening due to health protection or hygiene reasons, if the packaging was opened after delivery of the Goods;
8.10. The limitation referred to in point 8.9 applies in particular to home diagnostic tests, self-testing medical devices, and other products delivered in sealed packaging, the opening of which prevents their re-introduction to the market for health or hygiene reasons;
8.11. If the sealed packaging of the Goods has not been opened or tampered with, the Customer retains the right of withdrawal from the contract on the terms specified in this chapter;
8.12. The provisions of this chapter concern exclusively the right of withdrawal from a distance contract and do not limit the Customer’s rights arising from provisions concerning complaints and the Seller’s liability for non-conformity of Goods with the contract, specified in Chapter IX of the Terms and Conditions;

IX. Complaints and Conformity of Goods with the Contract

9.1. The Seller is liable to the Consumer and the Entrepreneur with Consumer Rights for non-conformity of Goods with the contract on the terms specified in the Act of May 30, 2014 on consumer rights;
9.2. Goods are in conformity with the contract if, in particular, their description, type, quantity, quality, completeness, functionality, and suitability for the purpose correspond to the conditions specified in the Sales Agreement;
9.3. Complaints concerning non-conformity of Goods with the contract may be submitted:
a) electronically to the email address: info@labhome.pl;
b) in writing to the Seller’s registered office address;
c) by phone, although for their effective consideration the Seller may ask the Customer to send the complaint on a durable medium (email or written form);
9.4. To facilitate the complaint process, the Customer should provide at least:
a) data enabling identification of the Order;
b) a description of the identified non-conformity of the Goods with the contract;
c) the request related to the complaint being filed;
9.5. Lack of proof of purchase does not constitute grounds for refusing to consider a complaint if the Customer is able to demonstrate the conclusion of the Sales Agreement in another way;
9.6. If the Goods are not in conformity with the contract, the Consumer or Entrepreneur with Consumer Rights may request their repair or replacement;
9.7. The Seller may make a replacement when the Consumer requests repair, or make a repair when the Consumer requests replacement, if bringing the Goods into conformity with the contract in the manner chosen by the Consumer would be impossible or would require excessive costs for the Seller;
9.8. The Seller will bring the Goods into conformity with the contract within a reasonable time from receipt of the complaint and without undue inconvenience to the Customer;
9.9. The costs of repair or replacement of the Goods, including shipping, collection, labor, and materials costs, are borne by the Seller;
9.10. If the Goods are not in conformity with the contract, the Consumer or Entrepreneur with Consumer Rights may make a statement of price reduction or withdrawal from the contract when:
a) the Seller refused to bring the Goods into conformity with the contract;
b) the Seller did not bring the Goods into conformity with the contract;
c) non-conformity of the Goods with the contract persists despite the Seller’s attempt to bring the Goods into conformity with the contract;
d) non-conformity of the Goods with the contract is so significant that it justifies a price reduction or withdrawal from the contract without prior request for repair or replacement;
e) the circumstances of the case indicate that the Seller will not bring the Goods into conformity with the contract within a reasonable time or without undue inconvenience to the Customer;
9.11. The reduced price should remain in such proportion to the price resulting from the Sales Agreement as the value of the Goods not in conformity with the contract remains to the value of Goods in conformity with the contract;
9.12. The Consumer or Entrepreneur with Consumer Rights may not withdraw from the contract if the non-conformity of the Goods with the contract is insignificant;
9.13. In the event of effective withdrawal from the contract, the Seller will refund the Customer the amounts due immediately, no later than within 14 days from the day of receiving the Goods or proof of their return;
9.14. The Seller will respond to the complaint within 14 days from the day of its receipt on a durable medium;
9.15. The provisions of this chapter do not limit or exclude the Customer’s rights arising from mandatory provisions of law;

X. labhome.pl reserves the right to:

10.1. Introduce new Products to the offer;
10.2. Withdraw Products from the offer;
10.3. Change Product prices in the offer;
10.4. Conduct promotional campaigns;
10.5. The Seller reserves the right to change the Terms and Conditions. Changes do not affect rights acquired by Customers before the date the changes take effect, in particular Orders placed before the effective date of the new version of the Terms and Conditions;

XI. Personal Data Protection

11.1. In order to ensure the security of its Customers’ data, labhome.pl takes organizational and technical measures to prevent the acquisition of personal data by unauthorized persons;
11.2 Personal data protection, including data processing, is described in detail in the Privacy Policy of labhome.pl

XII. Final Provisions

12.1. In matters not regulated by these Terms and Conditions, the provisions of the Civil Code, the provisions of the Act on the Provision of Electronic Services, and other legal acts in force in the territory of the Republic of Poland shall apply;
12.2. Any disputes between the Seller and the Consumer will be resolved by competent common courts in accordance with applicable law;
